TERMS & CONDITIONS

These Terms & Conditions govern the use of the Kleur & Co. online store and purchases made from KLEUR EN CO (PTY) LTD. By placing an order, you agree to these terms, subject always to rights that cannot lawfully be excluded under South African law.

1. About Kleur & Co.
Kleur & Co. is an online women's fashion boutique operated by KLEUR EN CO (PTY) LTD. We sell clothing, accessories and related fashion products to customers primarily within South Africa.
2. Products and Product Information
We take reasonable care to ensure that product descriptions, photographs, colours, measurements and sizing information are accurate. However, colours may display differently because of lighting, photography and device or screen settings.
Size guides and measurements are intended as guidance. Customers are encouraged to check the available measurements before ordering. Minor variations that are inherent to fabric, print placement or manufacturing do not necessarily constitute a defect.
3. Pricing and Currency
All prices displayed on our online store are quoted in South African Rand (ZAR). Delivery charges and any other applicable costs are displayed separately during checkout.
We may correct genuine pricing, stock or description errors. If an error materially affects an order already placed, we will contact the customer before proceeding and, where appropriate, offer cancellation and a refund.
4. Orders and Stock Availability
All orders are subject to stock availability and successful payment. Adding an item to a cart does not reserve that item.

As a small boutique, Kleur & Co. may carry only one or a limited number of units in each size or style. If an item becomes unavailable after an order is placed, we will notify the customer as soon as reasonably possible and refund any amount paid for the unavailable item in accordance with applicable law.
5. Payment
Payments are processed through approved third-party payment providers. Payfast is used as a payment gateway where enabled. Payflex may be offered as a payment option where available and subject to Payflex eligibility and approval.
Where a customer uses Payflex or another third-party payment service, that provider's separate terms may apply to the payment arrangement. Kleur & Co. remains responsible for the sale and supply of the goods in accordance with these Terms & Conditions and applicable law.
Orders will only be dispatched once payment has been successfully confirmed.
6. Delivery
Kleur & Co. currently delivers within South Africa. Standard courier delivery is charged at a flat rate of R150 per order unless a different promotion or delivery rate is clearly displayed.
In-stock orders are ordinarily processed and dispatched within 1-3 business days after successful payment. Courier transit time follows after dispatch and varies by destination and courier operations.

7. Pre-orders
Certain items may be offered on a pre-order basis. The product page will identify the item as a pre-order and state the estimated lead time.
A pre-order item will not be dispatched within the normal 1-3 business-day processing period unless it becomes available sooner. Statutory consumer rights are not removed merely because an item is sold as a pre-order. Different rules may apply where goods are genuinely made to a customer's specifications or clearly personalised.
8. Returns, Exchanges and Refunds
Returns, exchanges and refunds are governed by our Refund & Returns Policy and applicable South African law.
For qualifying electronic transactions, section 44 of the Electronic Communications and Transactions Act 25 of 2002 provides a cooling-off right under which a consumer may cancel a transaction for goods within seven days after receipt, without reason and without penalty, subject to statutory exclusions. The direct cost of returning the goods may be charged to the consumer.
Nothing in these Terms & Conditions limits rights that cannot lawfully be excluded under the Consumer Protection Act 68 of 2008 or other applicable law.
9. Size Exchanges
Size exchanges are subject to stock availability. Because Kleur & Co. carries limited quantities, we cannot guarantee that a requested replacement size will be available when an exchange is requested.
Where the replacement size is available, we will assist with an exchange in accordance with our Refund & Returns Policy. Where the requested size is unavailable, any applicable statutory cancellation or refund rights remain unaffected.

10. Promotions and Discount Codes
Promotions, discount codes and special offers may be subject to stated validity periods, stock limitations or additional promotional terms. Unless expressly stated otherwise, discount codes cannot be exchanged for cash or applied retrospectively to a completed order.
11. Customer Information and Privacy
Personal information supplied to Kleur & Co. may be used to process orders, facilitate payment, arrange delivery, provide customer service, prevent fraud and comply with legal obligations. We will handle personal information in accordance with applicable South African data-protection law and our Privacy Policy.
Customers are responsible for ensuring that delivery and contact details supplied at checkout are accurate and complete.
12. Intellectual Property
The Kleur & Co. name, logo, original website content, original photographs, graphics and written material are protected by applicable intellectual-property law and may not be reproduced or commercially used without permission, except where rights belong to a third-party owner.
13. Website Availability and Changes
We may update product ranges, website content and these Terms & Conditions from time to time. The version applicable to an order is the version made available when the order is placed. Temporary website interruptions may occur for maintenance or technical reasons.
14. Governing Law
These Terms & Conditions are governed by the laws of the Republic of South Africa. Any consumer rights or remedies available under applicable South African law remain available to the customer.
